Terms Of Use
1. Acknowledgment
This agreement is between you (the user) and Bettelf, located at ul. Wały Piastowskie 1/1508, Gdańsk, Poland (“we,” “us,” “our”). Apple Inc. (“Apple”) is not a party to this agreement. You acknowledge that Apple is not responsible for the app or its content.
2. User Responsibilities
Prohibited Activities: Users must not use Bettelf for illegal or improper activities, including but not limited to creating or sharing pornographic, racist, or violent content. We do not take responsibility for any improper or hurtful behavior within the app. Age Restrictions: There are no specific age restrictions for users beyond the minimum age set by the App Store (4 years old).
3. Scope of License
The license granted to you for Bettelf is a limited, non-transferable, non-sublicensable, and non-exclusive license to use the app on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the App Store Terms of Service. This license is for personal, non-commercial use only.
4. Maintenance and Support
You acknowledge that Bettelf is solely responsible for providing any maintenance and support services for the Bettelf app. Apple has no obligation to provide maintenance or support services for the app.
5. Warranty Disclaimer
Bettelf is provided 'as is,' without any warranties of any kind from Bettelf. To the maximum extent permitted by applicable law, we disclaim all warranties related to Bettelf, whether express or implied. Apple is not responsible for any warranties, and in the event of any failure of Bettelf to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Bettelf (if applicable). Apple has no other warranty obligation whatsoever with respect to the app.
6. Product Claims
Bettelf is responsible for addressing any claims by you or any third party relating to Bettelf, including, but not limited to, product liability claims, any claim that Bettelf fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple is not responsible for such claims.
7. Intellectual Property
User-Generated Content: Content created by users within the app belongs to the users. However, users must not distribute any app content if such distribution violates copyright rules, including exporting icons, names, descriptions, etc. Bettelf is responsible for addressing any intellectual property infringement claims made by third parties concerning Bettelf or your use of the app.
8. Legal Compliance
You must comply with applicable third-party terms of agreement when using Bettelf, such as your wireless data service agreement. You are solely responsible for ensuring that your use of the app is in compliance with the laws of your jurisdiction.
9. Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this agreement, and that, upon your acceptance of these Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.
10. Purchases and Payments
In-App Purchases and Subscriptions: Bettelf includes in-app purchases and subscriptions. Please note that we do not offer refunds for any purchases unless required by law.
11. Account Management
User Responsibility: Users are responsible for managing their own accounts.
12. Limitation of Liability
We are not liable for any issues arising from the use of Bettelf, including any damages or losses related to user content or activities, to the maximum extent permitted by applicable law.
13. Termination
This license is effective until terminated by you or Bettelf. Your rights under this license will terminate automatically without notice from us if you fail to comply with these Terms of Use. Upon termination of the license, you must cease all use of Bettelf and destroy all copies, full or partial, of the app.
14. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of Poland, excluding its conflicts of law rules. However, if the laws of your country of residence prohibit the choice of governing law, then your local laws will apply.
15. Dispute Resolution
We take no responsibility or liability for user actions within the app. Legal action will be taken in cases of copyright breaches. Any dispute arising out of or related to these Terms of Use shall be subject to the exclusive jurisdiction of the courts of Poland.
16. Changes to Terms of Use
Users will be notified of any changes to these Terms of Use via a notification within the app. Continued use of Bettelf after any changes constitutes acceptance of the new terms.
